Terms of Service

1. About Us

Y.M.I Roofing Pty Ltd (ACN 695 710 055) is an Australian-registered roofing and high-pressure cleaning business operating in Victoria. We service residential properties across Melton, the surrounding western suburbs and greater Melbourne. Details of our trade registration and licensing are available on request.

2. Quotes and Pricing

2.1 Free Quotes — We provide free, no-obligation written quotes for all roofing and cleaning services. Quotes are valid for 30 days from the date issued.

2.2 Fixed Price — Unless otherwise stated, our quotes are fixed-price. The price you see is the price you pay. We do not charge hidden fees.

2.3 Quote Variations — If unforeseen issues are discovered during work (e.g., hidden structural damage, asbestos), we will stop work, photograph the issue, and provide a revised quote before proceeding. You are not obligated to proceed with additional work.

2.4 No Call-Out Fee — We do not charge call-out fees for quotes within our service area. For properties outside our standard service area, we will disclose any travel fee before attending.

3. Australian Consumer Law Guarantees

Under the Australian Consumer Law, our services come with automatic guarantees that cannot be excluded:

• Due care and skill (s 60): Our work will be performed with due care and skill, to a standard expected of a competent roofing professional.
• Fit for purpose (s 61): Our work will be fit for the purpose you told us about, or for the purpose we represented it would be fit for.
• Reasonable time (s 62): Work will be completed within a reasonable time. We provide start and finish dates in writing before work begins.

If we fail to meet these guarantees, you are entitled to a remedy. See Section 6 below.

4. Our Workmanship Warranty

In addition to your rights under Australian Consumer Law, we offer a workmanship warranty on our roofing work. Ask us for the terms that apply to your job.

This warranty does not cover:

• Damage caused by severe weather events (storms, hail, falling trees)
• Damage caused by third-party work after our completion
• Normal wear and tear over time
• Issues arising from failure to maintain the roof (e.g., blocked gutters)

5. Cooling-Off Period (Unsolicited Agreements)

If we approach you unsolicited (e.g., door-to-door or cold call) and you agree to services, you have a 10 business day cooling-off period under the Australian Consumer Law.

During this period:

• You may cancel the agreement for any reason, without penalty
• We must not accept payment or supply services
• If you cancel, any money paid will be refunded promptly

The cooling-off period may be extended to 3 months if we visited outside permitted hours, did not disclose our purpose, or did not leave when asked. It may be extended to 6 months if we failed to inform you of your cooling-off rights or supplied services during the cooling-off period.

6. Remedies for Defective Work

If our work does not meet the consumer guarantees or our workmanship warranty:

• Minor problems: We will repair the defect at no cost within a reasonable time. If we cannot fix it, you may have the work done elsewhere and recover reasonable costs from us, or request a partial refund.
• Major failures: You may choose a full refund or have the work re-done by us at no cost. A major failure includes: the work is unsafe, significantly different from what was agreed, cannot be fixed within a reasonable time, or you would not have engaged us if you knew about the problem.

7. Payment Terms

7.1 Deposit — For jobs over $3,000, we may request a 10% deposit to secure materials. This is held in trust until work commences.

7.2 Progress Payments — For large jobs, we may agree to progress payments tied to milestones. These terms will be clearly stated in your quote.

7.3 Final Payment — The balance is due on completion of work, after you have inspected and approved the job. We do not require payment before you are satisfied.

7.4 Payment Methods — We accept bank transfer and cash. We do not accept credit cards. Invoices are provided for all work.

8. Cancellation by You

You may cancel a booked job by giving us reasonable notice. If you cancel:

• More than 48 hours before the scheduled start: no cancellation fee
• Within 48 hours of the scheduled start: we may retain the deposit to cover costs already incurred (materials, labour allocation)

9. Cancellation by Us

In rare circumstances (e.g., severe weather, safety concerns, unforeseen illness), we may need to reschedule work. We will notify you as soon as possible and offer the next available date. If we cannot complete the work within a reasonable time, we will refund any deposit in full.

10. Insurance and Liability

Where public liability insurance applies to your job, a current certificate of currency can be provided on request before work begins.

We are not liable for:

• Pre-existing defects in your roof or structure that were not visible or disclosed before work began
• Damage caused by your failure to maintain the roof after our work is complete
• Consequential loss (e.g., water damage to interior furnishings) that could have been prevented by timely maintenance

To the extent permitted by the Australian Consumer Law, our total liability is limited to the value of the services performed.

11. Dispute Resolution

If you have a dispute about our work:

1. Contact us first: Call Ben on 0422 093 241. Most issues are resolved quickly.
2. Written complaint: If not resolved by phone, send a written complaint to y.m.iroofing@outlook.com. We will respond within 14 days.
3. External resolution: If we cannot agree, you may contact:
   • Consumer Affairs Victoria — 1300 55 81 81
   • Building and Plumbing Commission (BPC) — for practitioner conduct complaints
   • Victorian Civil and Administrative Tribunal (VCAT) — for disputes up to $100,000

12. Records and Data Retention

We retain job records, quotes, invoices and related customer information for 7 years, in line with Victorian building and Australian taxation record-keeping requirements. After that period these records are securely deleted or destroyed. This retention obligation may override a request to delete your information; see our Privacy Policy for how we handle personal information.

13. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria.

14. Changes to These Terms

We may update these terms from time to time. The current version will always be available at ymiroofing.com.au/terms.html. Changes do not affect jobs already in progress.
